ESTATE LAW - Frequently Asked Questions
What effect does marriage or divorce have on the terms of a Will?
The law of Ontario specifies that a Will is automatically revoked by marriage unless the Will specifically states that it is being made in contemplation of a particular marriage. With respect to divorce, unless a contrary intention is expressed, an order of divorce will revoke the provisions in the Will which favour the former spouse.
