ACCIDENT BENEFITS
Your own automobile policy requires your insurer to provide you with certain benefits should you be injured in a motor vehicle accident. If you are involved in an accident and don’t have your own automobile policy than you will be provided with these same benefits by the insurer of someone you live with or the insurer of one of the other drivers involved in the accident. Some of the benefits that you may qualify to receive following an accident are listed below.
There are some critical steps that you must take soon after the occurrence of an accident. You must notify your accident benefit insurer within 7 days of an accident and your application for accident benefits must be completed within 30 days of you receiving the forms from the insurer. These steps are important and it is wise to seek the advice of experienced lawyers to assist you early on in this process.
Medical and Rehabilitative Benefits
This benefit will cover
medical and rehabilitative expenses over and above that covered by
OHIP. Common expenses include the costs of physiotherapy treatment.
Attendant Care Benefits
This benefit will cover the costs of personal
care services that you require as a result of the accident.
Income
Replace Benefits
This benefit will be paid to you as long as you
are unable to perform the essential tasks of the occupation that
you held at the time of the accident. This benefit is equal to 80%
of your net income to a maximum of $400 per week.
Non-Earner Benefits
This benefit will be paid to
you if you were not employed at the time of the accident and are
unable to perform your normal activities of daily living. This benefit
is $185 per week but eligibility doesn’t
begin until 6 months after the date of the accident.
Caregiver Benefits
This benefit will be paid if you were the primary care giver for
a person in need of care and as a result of the accident are no longer
able to provide that care. This benefit is up to $250 per week plus
an additional $50 per week for each additional person requiring care.
Housekeeping and Home Maintenance Benefits
This benefit will be
paid as a reimbursement of expenses you incur as a result of family
members or other persons having to perform housekeeping and home
maintenance duties on your behalf. This benefit is up to $100 per
week.
